If You do not understand or have questions about the Privacy Notice or the SHIFTit Terms of Use, immediately stop all use of the Website and/or Services. This Privacy Policy, effective as of the above-stated Revision Date (“Effective Date”), explains how SHIFTit Corp., a Wyoming corporation (hereinafter, “SHIFTit”), collects and uses information when you, the end-user (hereinafter, “You” or “Your”), visit the SHIFTit Website and any other subpages or applications on the SHIFTit Website domain (which SHIFTit may create, remove, or modify at its sole discretion) or when You schedule any Medical Services through the SHIFTit Website. This Privacy Policy is published at https://shiftithealth.com/privacy-policy and applies to all users of the SHIFTit Website and Services, users of any other websites or applications with SHIFTit branding that link to this Privacy Policy, any Accounts providing or using Medical Services through the SHIFTit Website, and where links to this Privacy Policy are published in any other terms, conditions, policies, or similar such items. SHIFTit follows this Privacy Policy in accordance with applicable law in the places where SHIFTit operates.

This Privacy Notice does not apply to other websites to which SHIFTit may otherwise link, or to other companies, third-party vendors who provide services to SHIFTit, or entities who might be listed as third-party contacts on the SHIFTit Website, each of which may be governed by their own privacy policies. This Privacy Policy applies to information collected through the SHIFTit Website and any other information collected in any other manner in other interactions, whether over the internet, phone, in-person, or any other medium of communication with SHIFTit or its employees, agents, affiliates, partners, successors, or assigns. This Privacy Notice also does not apply to information SHIFTit may obtain from other sources about You. By using the SHIFTit Website and/or by contacting SHIFTit and providing any personal information, You consent to the collection, transfer, storage, disclosure, and use of any such information by SHIFTit in accordance with this Privacy Notice. In addition, if You use any social networking connection functions that may be offered through the SHIFTit Website, SHIFTit may access any of Your social profile information that You have made available to be shared, and SHIFTit may use any such information so obtained in accordance with this Privacy Policy. Types of Personally Identifiable Information Collected. Personally identifiable information is information that can be used to identify, locate, or contact You (“Personal Information”). It also includes other information that may be associated with Personal Information. SHIFTit collects information from You when You visit and/or schedule services through the SHIFTit Website. The following information may be collected by SHIFTit from You:

  • Registration information when You schedule services through the SHIFTit Website or enter a SHIFTit promotion, such as Your first name, last name, email address, and phone number;

  • Transaction information provided by You when requesting services;

  • Phone calls between SHIFTit and You, and any information contained therein;

  • Information You provided on SHIFTit documents and forms;

  • Location information, including location information provided by a laptop computer, tablet, mobile smartphone, or other similar such device interacting with the SHIFTit Website, or associated with Your IP address or other online identifier, where SHIFTit is permitted by law to process such information;

  • Images, recordings, or any other similar such materials in any medium that may contain Your Personal Information;

  • Activity information about Your use of the SHIFTit Website, such as content viewed, how often You use the SHIFTit Website, and Your preferences;

  • Any images uploaded by You, for purposes of associating the image with Your Account “profile picture” or any other similar such type of picture identifying You as the Medical Professional or Healthcare Provider associated with the Account;

  • Background check information if You sign up to use the Services as a Medical Professional or Healthcare Provider, such as information about Your work history, certifications, and/or educational history (where permitted by law), and such information may be collected by a vendor on SHIFTit’s behalf; and

  • Demographic information about You, including information acquired through user surveys; in some countries, SHIFTit may also receive demographic information about You from third parties.

The above-referenced information constitutes Personal Information and, as such, is subject to the terms and conditions of this Privacy Policy.

From time to time, SHIFTit may also supplement Personal Information with information collected from third parties, including demographic information about You interests and similar information that third parties have collected from other sources, for the purposes to validate the accuracy of Your information, to better understand You, to provide You with targeted advertising, and to improve the delivery of the SHIFTit Website and/or any Services obtained through the SHIFTit Website to You.

How Information is Collected. SHIFTit asks for the Personal Information listed above as part of an online registration process to receive services from SHIFTit. SHIFTit also collects information when You request information from SHIFTit, market, provide, or obtain Medical Services from SHIFTit, enter a SHIFTit promotion, or visit the SHIFTit Website. When either SHIFTit or You initiate a call with the other party, SHIFTit may monitor and/or record those calls for quality assurance and customer satisfaction purposes. In those jurisdictions where consent is required for a party to record a telephone call, You consent to SHIFTit recording such calls.

SHIFTit may collect Your precise location data through the SHIFTit Website. SHIFTit collects this information to help enable the functionality of the SHIFTit Website, and SHIFTit may also collect the precise location of Your device when You access the SHIFTit Website via that device. SHIFTit may also derive Your location from Your IP address. The SHIFTit Website uses geo-location features to help enable You to search for services that may be obtained through the SHIFTit Website, to improve the SHIFTit Website and/or any services that may be obtained on the SHIFTit Website, and/or for any other reasonable business purpose of SHIFTit, such as a legal purpose, a merger or sale of SHIFTit, or any business-related asset transfers. The geo-location data obtained about You will be stored in an identifiable manner, along with geo-location data about any project sites where You requested or performed services obtained through the SHIFTit Website. In addition to tracking Your geo-location, the Services also track Your activity across third-party applications and websites. This allows SHIFTit to deliver an enhanced experience when You visit the SHIFTit Website and use the Services. SHIFTit gives You the ability to opt-in or opt-out of SHIFTit’s geo-location and tracking features. When interacting with our Services, a pop-up screen will appear, which will prompt You to allow the Services to access Your geo-location data. A pop-up screen will also appear which will prompt You to allow the Services to track Your activity across other companies’ apps and websites. If, at any time, You decide that You do not want to share Your geo-location data and/or activity with the Services, You can opt-out at any time by changing the relevant settings in Your Account.

SHIFTit may collect information about Your mobile device or other device You use to access the SHIFTit Website, including, but not limited to, the following information: the hardware model, operating system and version of that operating system, software and/or application names and version numbers, file names and version numbers, preferred language of the device, unique device identifiers, advertising identifiers, device serial number, device motion information, and mobile network information. Information is used to communicate with You about transactions with SHIFTit, to provide personalized content and experiences, to provide additional information that may be of interest to You about the Services or Medical Services, SHIFTit, and/or any of its subsidiaries, affiliates, or partners (such as special offers, promotions, announcements, and information about potential service offerings), and to detect, prevent, and investigate activities that may violate SHIFTit policies, terms, or conditions, or otherwise be fraudulent, illegal, and/or pose safety issues to SHIFTit or any third-parties using the Services.

Cookies, Web Beacons, Clear-GIFs, Pixel Tags, JavaScript, and Third-Party Technologies. SHIFTit may use cookies and other identification technologies on SHIFTit’s Services, the SHIFTit Website, emails, and online ads for the purposes described in this Privacy Policy. Cookies are small text files that are stored on your browser or device by websites, apps, online media, and advertisements. SHIFTit uses cookies and similar technologies for purposes including, but not limited to, the following:

  • Authenticating Accounts;

  • Remembering Account preferences and settings;

  • Determining the popularity of content;

  • Delivering and measuring the effectiveness of advertising campaigns; and

  • Analyzing site traffic and trends, and generally understanding the online behaviors and interests of people who interact with the Services.

SHIFTit may use “pixel tags” (also called “action pixels,” “web beacons,” or “clear gifs”) and/or JavaScript plug-ins, placed on the SHIFTit Website and in SHIFTit emails to You. These web beacons and plug-ins are small graphic images (typically that you cannot see) or codes on a website or in an email message which are used for such things as recording webpages and advertisements clicked on by a user or for tracking the performance of email marketing campaigns. These devices help SHIFTit analyze online behavior and measure the effectiveness of the SHIFTit Website and marketing. SHIFTit may collect “Server Log” information, which is a record of activity created by a computer that delivers certain webpages to Your internet browser. Certain activities that You perform on our Website may record information in Server Logs. For example, if You enter a search term into a search box located on the Website, the Server Log may record the search term, the link You clicked on to bring You to our Website, and/or information about Your browser, such as Your IP address and the cookies set on Your browser.

SHIFTit may also work with third-party service providers that help SHIFTit track, collect, and analyze this information. Third-party entities with whom SHIFTit has agreements may place these devices on the SHIFTit Website and/or in emails to use information obtained from them, such as pages viewed, items purchased, emails opened, and items upon which You may click in emails. These third-party providers may also place cookies onto Your computer. Those third-party cookies may enable us to obtain aggregate demographic information and user statistics about you and your preferences from these third-party sources, as well as SHIFTit’s own information about You. SHIFTit may also allow others to provide audience measurement and analytics services for SHIFTit, to serve advertisements on SHIFTit’s behalf across the internet, and to track and report on the performance of those advertisements. These entities may use cookies, web beacons, and other technologies to identify Your device when You visit the SHIFTit Website and/or use the Services, as well as when You visit other internet sites and services.

How SHIFTit Uses Personal Information. The primary purpose of the Personal Information collected on the SHIFTit Website is to improve, optimize, and further develop the SHIFTit Website. Specifically, Your Personal Information is used to communicate with You about transactions with SHIFTit, to provide personalized content and experiences, to provide additional information that may be of interest to You about the SHIFTit Website, SHIFTit, and/or any of its subsidiaries, affiliates, or partners (such as special offers, promotions, announcements, and information about potential service offerings), and to detect, prevent, and investigate activities which may violate SHIFTit policies, terms, or conditions, or otherwise be fraudulent, illegal, and/or pose safety issues.

Specifically, SHIFTit may use Personal Information for business purposes, including but not limited to: (i) providing services You may seek; (ii) analyzing trends and conducting research; (iii) providing support and responding to questions from users, SHIFTit Website visitors, and customers; (iv) improving the SHIFTit Website or Services; (v) learning about user and customer needs; (vi) contacting users for research, informational, and marketing purposes, including customizing the SHIFTit Website for You based upon Your information and browsing habits; (vii) tracking traffic patterns and SHIFTit Website usage; (viii) providing customer service and technical support; (ix) correlating Personal Information with other commercially available information to identify demographics and preferences to assist SHIFTit in research and marketing efforts; (x) providing specific relevant marketing, promotional, or other information to You; (xi) addressing information security and/or privacy practices, network functionality, engineering, and/or troubleshooting issues; (xii) investigating legal actions, violations of law, contractual violations, and compliance with relevant applicable laws and legal processes; (xiii) complying with applicable laws, or based on SHIFTit’s good faith belief that use of Personal Information is necessary to conform or comply with applicable laws or to protect the rights, property, or safety of visitors to the SHIFTit Website, SHIFTit’s partners or customers, or the public; and (xiv) processing or engaging in a sale of all or part of SHIFTit’s business or if SHIFTit otherwise goes through a reorganization or merger.

SHIFTit may also share Personal Information and other information with SHIFTit affiliates and business partners, as well as with other third-party service providers who help SHIFTit provide operational services for the SHIFTit Website and business, which might include, but is not necessarily limited to: business entities that provide e-mail address management and communication contact services, retargeting services, network equipment and application management providers and hosting entities, entities which obtain information such as demographic information which might be aggregated with information we have about You, entities that allow SHIFTit to personally identify visitors to the SHIFTit Website, judicial, administrative and/or legal or financial accounting providers in the event that information must be reviewed or released in response to civil and/or criminal investigations, claims, lawsuits, or if SHIFTit is subject to judicial or administrative process (such as a subpoena) to release Your information or to prosecute or defend legal actions, and other service providers which may be involved in the other types of services and activities otherwise discussed in this Privacy Policy. SHIFTit may also use Your Personal Information to contact You in ways other than e-mail or regular mail, such as via telephone or facsimile. All use of Personal Information will be as permitted by applicable law.

Opting Out and Updates to Your Personal Information. SHIFTit does not rent, sell, or share Your Personal Information with other parties or non-affiliated companies for their direct marketing purposes without Your express consent. SHIFTit provides You the opportunity to opt out of receiving marketing communications from SHIFTit and its agents, subsidiaries, affiliates, partners, and successors, and assigns and gives You the option to remove Your information from the SHIFTit Website, to not receive future marketing communications, or to no longer receive access to the SHIFTit Website and any services that may be obtained through the SHIFTit Website. You may opt out of the sharing or sale of Your Personal information by contacting SHIFTit Support via email at hello@shiftithealth.com, or by visiting the opt-out page. If You receive an unsolicited marketing communication from the SHIFTit Website, please contact SHIFTit by sending a written request to the address provided in the section of this Privacy Policy entitled “Notice.” You may also make requests regarding Your Personal Information, such as requests to access information or requests to update or correct inaccurate information, by sending a written request pursuant to the methods of providing notice to SHIFTit as set forth in the section of this Privacy Policy entitled “Notice.”

You may request to have SHIFTit delete Your Personal Information by contacting SHIFTit via the methods of providing notice to SHIFTit, as set forth in the section of this Privacy Policy entitled “Notice.” SHIFTit will remove Your Personal Information within a reasonable time period of receipt of Your written request and only after SHIFTit has verified the identity of the requestor. SHIFTit may retain and use information in its records as described in this Privacy Policy and as required by law.

Security and Retention of Personal Information. SHIFTit follows generally accepted industry standards to store and protect Personal Information, secure servers, databases only accessible by those authorized with special access rights to such systems, and routine monitoring of these systems and data. No method of electronic data transmission or storage is completely secure, and for this reason, there is no guarantee that information will not be accessed, disclosed, altered, lost, or destroyed by breach of any of SHIFTit’s physical, technical, or managerial safeguards. SHIFTIT EXPRESSLY DISCLAIMS ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESSED OR IMPLIED, WITH RESPECT TO ENSURING, GUARANTEEING, OR OTHERWISE OFFERING ANY DEFINITIVE PROMISE OF SECURITY IN CONNECTION WITH YOUR PERSONAL INFORMATION, AND FURTHER DISCLAIMS ANY LIABILITY THAT MAY ARISE SHOULD ANY OTHER INDIVIDUALS OBTAIN THE PERSONAL INFORMATION YOU HAVE SUBMITTED TO THE SHIFTIT WEBSITE. SHIFTit keeps Your personal data only as long as necessary to provide You with access to the SHIFTit Website, services obtained through the SHIFTit Website, and other legitimate and essential business purposes.

Retention and Data Deletion of Personal Information

To change or delete information You have provided to SHIFTit, You may login to Your Account and modify or remove any of the information contained in Your Account. You may delete Your Account by clicking the “delete account” button under the profile settings in Your Account. SHIFTit will also remove Your Account within a reasonable time period of receiving Your written request to delete Your account, sent pursuant to the notice requirements of this Privacy Policy and only after SHIFTit has verified the identity of the requestor. Please be aware that even after Your Account is deleted, information that You chose to provide or publish in a public area of the SHIFTit Website will remain available to the general public and may remain in the accounts of others with whom such information has been shared. SHIFTit may retain and use information in its records as described in this Privacy Policy. SHIFTit keeps Your personal information only as long as necessary to provide You with access to the SHIFTit Website, Services, and/or Medical Services You obtain through the SHIFTit Website, and other legitimate and essential business purposes. Your personal information will be deleted in accordance with our data retention and destruction policies. We will delete the personal information which You request that we delete, unless it is necessary to:

  • Complete the transaction for which SHIFTit collected it, provide the Services You requested, take actions reasonably anticipated within the context of SHIFTit’s ongoing business relationship with You, or otherwise perform SHIFTit’s contractual obligations to You;

  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;

  • Debug the product to identify and repair errors that impair its intended functionality;

  • Exercise free speech, ensure the right of another consumer to exercise his or her free speech rights, or exercise another right provided for by law;

  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code §1546 et seq.); and

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when deletion may likely render impossible or seriously impair the research’s achievement, if You previously provided informed consent.

General Data Protection Regulation and Visitors to the SHIFTit Website from Outside of the United States. In the event SHIFTit shares Personal Information with third parties pursuant to the terms of this Privacy Policy, and those third parties are located in countries other than Your home country, such Personal Information may be subject to privacy laws that are different from those in Your country of residence. SHIFTit is headquartered in Beverly Hills, California, and does not anticipate collecting Personal Information from individuals residing in the European Union; however, in the event that any transaction related to the SHIFTit Website or services obtained through the SHIFTit Website involves the transmission of Personal Information by an individual located in the European Union, any such transfer will comply with General Data Protection Regulation requirements.

If You are visiting the SHIFTit Website from a location outside of the United States, please be aware that Your connection to the SHIFTit Website may be through servers located in the United States. Furthermore, please be aware that the data protection laws in the United States or other countries may not be the same as those in Your country where You are connecting to the SHIFTit Website. By using the SHIFTit Website and/or submitting information to SHIFTit, You specifically consent to the transfer of Your information to the United States to the facilities and servers SHIFTit uses, and to those with whom SHIFTit may share Your information.

Privacy Practices of Third Parties and Links. SHIFTit may display advertisements or other content that is from and/or links to third-party websites. SHIFTit cannot control or be held responsible for the content and privacy practices of any third party or third-party website, application, link, or other third-party service. If You click on third-party content or links, please be aware that You are leaving the SHIFTit Website and any Personal Information or other information that You provide to any third party will not be covered by this Privacy Policy.

SHIFTit encourages our suppliers, vendors, agents, subsidiaries, affiliates, partners, successors, and assigns to adopt and post privacy policies. However, the use of Your Personal Information by such parties is governed by the privacy policies of those parties and is not subject to SHIFTit’s control. When You choose to interact with any of SHIFTit’s suppliers, vendors, agents, subsidiaries, affiliates, partners, successors, assigns, or any other third party, it is encouraged that You read any applicable privacy policy posted by that particular party.

Use of Google AdWords for Remarketing. SHIFTit uses remarketing services to advertise on third-party websites (including Google) to previous visitors to the SHIFTit Website. This means that SHIFTit may provide advertisements or marketing to previous visitors who have started but not completed a task on the SHIFTit Website (i.e., using a contact form or Account registration form to make an inquiry but only partially completing the form). This could be in the form of an advertisement on the Google search results page or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on someone’s past website visits. Any such data collected will be used in accordance with this Privacy Policy and Google’s privacy policy. You can set preferences for how Google advertises to You using the Google Ad Preferences page. You may also elect to opt out of interest-based advertising entirely through cookie settings or permanently using a browser plugin.

Children’s Online Privacy Protection Act. SHIFTit does not intend or permit any individuals under the age of eighteen (18) to use the SHIFTit Website or obtain any services related to the SHIFTit Website, and any such use by any individual under the age of eighteen is prohibited. By using the SHIFTit Website, You represent that You are at least eighteen (18) years of age and understand that You must be eighteen years old to register and receive access to the SHIFTit Website. SHIFTit will promptly delete any information associated with any records where SHIFTit has actual knowledge that this policy is being breached.

California Privacy Rights. Pursuant to §1798.83 of the California Civil Code, residents of California can obtain certain information about the types of Personal Information that companies with whom they have an established business relationship have shared with third parties for direct marketing purposes during the preceding calendar year. In particular, the law provides that companies must inform consumers about the categories of personal information that have been shared with third parties, the names and addresses of those third parties, and examples of the types of services or products marketed by those third parties. To request a copy of the information disclosure provided by SHIFTit pursuant to §1798.83 of the California Civil Code, please contact SHIFTit via certified mail, as provided in the “Notice.” section of this Privacy Policy.

California Consumer Privacy Act (“CCPA”). Pursuant to §1798.100 of the California Civil Code, residents of California are provided specific legal rights regarding personal information. These rights include: 1) the right to request that a business disclose the specific personal information collected; 2) a business shall inform consumers at or prior to the point of collection as to the categories of personal information not to be collected and for what purposes it will be used; 3) a business will only disclose personal information to a consumer upon receipt of a verifiable consumer request; 4) a business is required to respond to verifiable customer requests to access personal information at least twice in a twelve (12) month period; and 5) information from a one-time transaction that is not sold or retained by the business does not need to be retained by the business.

Please be aware that SHIFTit cannot respond to a request if it cannot sufficiently verify the identity of the requestor or if the request lacks sufficient details to enable SHIFTit to facilitate the request.

All notices to You regarding this Privacy Policy will be sent via e-mail to Your email address on file with SHIFTit at the time of the sending of the notice; if SHIFTit does not have Your email address on file, then notice to You will be provided by first-class mail. SHIFTit reserves the right to update this Privacy Policy; any such changes are deemed effective as of the earlier date between the date You receive notice of the changes or thirty (30) days after the date such updated terms are published on the SHIFTit Website. Thereafter, continued usage of the SHIFTit Website and/or any services obtained through the SHIFTit Website constitutes acceptance of any new terms and/or modifications to the Privacy Policy.
